Terms of Use

1. Introduction

These Terms of Use govern access to and use of the Automizia platform, a product of Inoovexa, registered under CNPJ 17.951.035/0001-09, headquartered in Fortaleza-CE. By accessing or using Automizia, you agree to comply with these terms. If you do not agree with any part of these terms, do not use the platform.

2. Acceptance of Terms

By creating an account on Automizia, you declare that you have read, understood, and accepted these Terms of Use and our Privacy Policy. If you do not agree with any of the terms, you must discontinue use of the platform immediately.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account. You must notify Inoovexa immediately in case of unauthorized use of your account. Inoovexa is not responsible for losses resulting from unauthorized use of your account.

4. Acceptable Use

When using Automizia, you agree not to:

• Violate any applicable laws or regulations.
• Publish content that infringes third-party intellectual property rights.
• Use the platform to send spam, malware, or malicious content.
• Attempt to access other users' systems or accounts without authorization.
• Reverse engineer, decompile, or attempt to extract the platform's source code.

5. User Content Responsibility

You are solely responsible for all content created, edited, scheduled, and published through the Automizia platform. The platform operates as a scheduling and publishing tool, but does not exercise editorial control over posts. Any published content is entirely the user's responsibility, including its legality, accuracy, originality, and compliance with the social networks' policies and applicable laws.

6. Platform and Content Removal Rules

You must follow the same content rules permitted on the social networks connected to Automizia (Instagram, X/Twitter, TikTok, and others). Content that violates the guidelines of these platforms or Brazilian legislation may be removed from the platform without prior notice. In cases of recurrence or persistence of prohibited content, Inoovexa reserves the right to suspend or completely block the user's access to the platform, without entitlement to a refund.

7. Artificial Intelligence Use and Generated Content

Automizia offers artificial intelligence (AI) tools to assist in creating captions, texts, and images for social media. By using these features, you acknowledge and agree that: 1. The platform does not exercise editorial control over AI-generated content, functioning solely as a content creation assistance tool. 2. You are the sole and entire party responsible for all content generated, edited, scheduled, and published through the AI tools, including verifying its legal adequacy and compliance with the guidelines of the connected social networks. 3. Inoovexa is not liable for improper, offensive, discriminatory, defamatory content, or content that violates copyright or intellectual property rights, or that infringes community guidelines and terms of use of social media platforms, even if such content was generated or suggested by AI algorithms available on the platform. 4. It is forbidden to use Automizia's AI tools to create, disseminate, or promote misinformation, spam, misleading content, material protected by copyright without authorization, or any content prohibited by law or by the policies of the connected social networks. 5. You agree to review and validate all AI-generated content before publication, ensuring that it is aligned with applicable Brazilian laws, including but not limited to LGPD, Copyright Law, and the Brazilian Civil Rights Framework for the Internet.

8. Intellectual Property

All content, trademarks, logos, design, code, and other elements of the Automizia platform are the property of Inoovexa and are protected by applicable intellectual property laws. Content generated by you and published through the platform remains your property. By generating content using Automizia's AI tools, you grant Inoovexa a limited license to process and deliver that content.

9. Service Availability

Automizia is provided "as is" and "as available." Inoovexa reserves the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice. We will make reasonable efforts to maintain platform availability, but we do not guarantee that the service will be uninterrupted or error-free. Images and videos uploaded to the platform are stored temporarily only until publication on the respective channel and may be automatically removed within 30 days after publication.

10. Limitation of Liability

Inoovexa shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use Automizia. Inoovexa's total liability for any claim shall not exceed the amount paid by you in the last 12 months of subscription. In particular, Inoovexa shall not be liable for AI-generated content that is inappropriate, illegal, offensive, discriminatory, defamatory, that violates third-party rights, or that infringes community guidelines or terms of use of social networks. The use of AI tools is entirely your responsibility.

11. Termination

Inoovexa may suspend or terminate your account at any time, with or without cause, upon notice. You may terminate your account at any time through account settings. After termination, your data will be retained for the period necessary to fulfill legal obligations and subsequently deleted.

12. Changes to Terms

Inoovexa may modify these Terms of Use at any time. Significant changes will be communicated via email or a notice on the platform. Continued use of Automizia after changes are published constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be submitted to the courts of the Comarca de Fortaleza, State of Ceará.
